By accessing or using the Asheville Automation website (ashevilleautomation.com) or engaging Asheville Automation for professional services, you agree to be bound by these Terms of Service. Asheville Automation is a brand of Fision Analytics ("Company," "we," "us," or "our"). If you do not agree to these terms, please do not use this website or our services.

Asheville Automation provides AI consulting, workflow automation strategy and implementation, team training, and related professional services to small and mid-size businesses. The specific scope, deliverables, pricing, and timeline for any engagement are defined in individual service agreements, statements of work, or written proposals provided to each client. These Terms of Service govern the general relationship between you and the Company; project-specific terms in a signed agreement take precedence in case of conflict.

3. Use of This Website

You may use this website for lawful purposes related to learning about and engaging our services. You agree not to:

  • Scrape, crawl, or systematically extract data from this website without written permission
  • Attempt to circumvent or disable any security feature of this website
  • Submit false, misleading, or fraudulent information through any form on this site
  • Use this website in any manner that violates applicable local, state, or federal law

With respect to custom work product delivered to clients under a service agreement, ownership is defined in the applicable project agreement. Unless otherwise specified in writing, clients receive a license to use the delivered work product for their internal business operations.

This website is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.

With respect to professional services, we apply our best expertise and professional judgment to every engagement. However, we make no guarantee that any AI tool, automation, or strategy will produce specific business outcomes. Results depend on factors including your team's implementation, data quality, existing systems, and business context, many of which are outside our control.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Fision Analytics shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from your use of this website or our services, even if we have been advised of the possibility of such damages.

Our total liability to you for any direct damages arising from a professional services engagement shall not exceed the total fees paid by you to us in the 90 days immediately preceding the event giving rise to the claim.

7. Client Responsibilities

Clients engaging Asheville Automation for professional services agree to provide accurate and complete information necessary for project delivery, offer timely feedback and approvals to keep projects on schedule, grant reasonable access to systems, software, and data required for the engagement, and designate a point of contact with appropriate authority to make decisions related to the project.

Delays caused by a client's failure to meet these responsibilities may affect project timelines and deliverables.

8. Governing Law

These Terms of Service and any disputes arising from your use of this website or our services shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.

9. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or our services, the parties agree to first attempt resolution in good faith through direct communication. If a dispute cannot be resolved through good-faith negotiation within 30 days, it shall be submitted to binding arbitration administered in Buncombe County, North Carolina, in accordance with applicable arbitration rules. Each party shall bear its own costs and fees unless the arbitrator determines otherwise.
